Terms of Service
This is an English translation provided for information. The binding version is the Polish one, and in case of any discrepancy the Polish version prevails.
Version of 28 October 2026
§ 1. Who provides the service
- The “Social Media Centre” service (the “Centre”) is provided by Iwaszka Jacek Iwaszkiewicz, Odonów 168, 28-500 Kazimierza Wielka, Poland, NIP (Polish tax identification number) 795-25-38-265 (the “Provider”).
- Contact: e-mail kontakt@iwaszka.pl — this is also the point of contact for authorities and recipients of the service within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 (DSA); language of contact: Polish.
- The Centre operates at https://social.iwaszka.pl.
§ 2. Definitions
- Client — a business (a natural person carrying on a business activity, a legal person or an organisational unit without legal personality) that has concluded an agreement for the Centre. The Centre is not a service for consumers.
- Brand — a profile of a company, product or person whose social media the Client manages in the Centre. The fee is charged per Brand.
- User — a person to whom the Client has given access to the Centre (an account with a password and a code from an authenticator app).
- Assistant — a function of the Centre which, on the basis of the Brand’s notes, strategy and brand notes, prepares drafts of texts, topics, scripts and replies. The Assistant uses language models of a third-party provider.
- Image and Video Generator — a function that commissions the generation of an image or a short video from a third-party provider — from a real product photograph or as a background without the product.
- Approval — a decision of a User authorised by the Client that a given piece of content may be published. It applies to exactly that version of the content — any change requires a new Approval.
- Plan — the scope of the service and the monthly price set out in § 4.
§ 3. What the Centre does — and what it does not do
- The Centre makes it possible to: plan publications; prepare posts, stories and reels; collect ideas and materials; approve content; publish it at the scheduled time on connected accounts (Facebook, Instagram — via the Meta interface; X — via the X interface) or prepare a package for manual publication (e.g. LinkedIn); collect results and comments; and maintain the Brand’s strategy and brand notes.
- Nothing is published without Approval. The Assistant and the Generator prepare drafts and working materials only. The Provider does not approve content on the Client’s behalf, unless the parties conclude a separate agreement for social media management (§ 4(7)).
- The Assistant may make mistakes. Texts prepared with the help of language models may contain untrue statements or errors. The Assistant bases facts on the Brand’s note, strategy and brand notes, but the Client who approves the published content is responsible for its truthfulness and lawfulness.
- The Client does not receive access to the language model or a key to it — the Client purchases the Assistant’s work in the Centre.
- The Centre does not guarantee reach, numbers of followers or sales. Social media platforms decide on the display of content themselves and may change their rules or interface without notice. Unavailability of a platform or its refusal to publish is not a defect of the service — the Centre informs the User of it and does not retry the publication without the User’s decision.
§ 4. Plans and prices
Prices are net, per Brand, per calendar month:
| Plan | What it includes | Price |
|---|---|---|
| Start | fee for the Brand: calendar and weekly plan, posts, stories and reels, approval, publication from the Centre (Facebook, Instagram, X), packages for manual publication, results and comments, strategy and brand notes, Brand Users | PLN 50 |
| Assistant 30 | the same as “Start” plus the Assistant (drafts from notes, topics for empty days, recording scripts, draft replies to comments) and assessment of a post before Approval — AI work limit indicatively for approx. 30 posts per month | + PLN 39 |
| Assistant 60 | the same as “Assistant 30”, with a limit indicatively for approx. 60 posts per month (approx. 2 per day) | + PLN 79 |
| + AI graphics and videos | add-on: Image and Video Generator — a separate limit, indicatively approx. 30 five-second videos or approx. 115 new shots; also with the Client’s own AI key | + PLN 49 |
| Limit top-up | additional AI work limit or Generator limit for the current month (up to 5 top-ups at a time) | PLN 20 per top-up |
- VAT is added to the prices at the rate applicable on the date the invoice is issued. The Assistant and AI graphics and videos work only together with the fee for the Brand (the “Start” plan) — they cannot be purchased separately. The Client may also use the Assistant with its own key from an AI provider (paying that provider directly, under its price list); in that case the Client pays for the “Start” plan and — if it wishes — for the “AI graphics and videos” add-on.
- Plans with the Assistant and the “AI graphics and videos” add-on have a monthly AI work limit. The Centre shows what percentage of the limit has been used. The numbers of posts and videos in the table are indicative: consumption depends on the length of texts, the number of versions, assessments before Approval and the type of video. Once the limit is exhausted, the Assistant or the Generator stops until the beginning of the following month or until the limit is topped up; the other functions continue to work. Any unused limit, including a purchased top-up, does not carry over to the following month.
- An image or video request rejected by the provider (e.g. a content filter, an error) or cancelled in the queue does not consume the limit.
- Switch on today. The Client may switch on Assistant 30, Assistant 60 or AI graphics and videos in the Centre with immediate effect. The add-on works from the moment it is switched on, with the full limit for the current month; for the current month the Client pays the difference between the price of the new plan and the previous one (for the whole month, without pro-rating by days), on the basis of a separate invoice. From the following month, the price of the new plan applies.
- A change of plan to a lower one or cancellation of an add-on — the Client requests it with the “Request a plan change” button in the Centre or by e-mail; it takes effect from the first day of the following month.
- The Provider may change prices in accordance with § 12(1) — the new price applies from the first billing period after the change takes effect.
- Social media management (preparing and publishing content on the Client’s behalf) requires a separate order by e-mail or in writing, specifying the scope, the number of publications, the platforms and the person approving the content.
§ 5. Registration and conclusion of the agreement
- An account is created using the “Create account” form on the Centre’s website: company name, NIP, first name and surname of the person creating the account, e-mail address and login, and — if the Client has one — a discount code. By submitting the form, the Client accepts these Terms.
- The Centre sends a confirmation link, valid for 24 hours, to the e-mail address provided. The agreement is concluded at the moment the account is confirmed using that link — for an indefinite period, with a billing period of one calendar month.
- After confirmation, the User sets a password and a code from an authenticator app, and then creates a Brand in the wizard. An account created through registration may create one Brand; further Brands — after contacting the Provider.
- The fee for a Brand is due from the month in which the Brand was created in the wizard.
- The Provider may refuse to create an account or may block an account created in breach of these Terms (e.g. false company details, the NIP of a non-existent entity), informing the Client of this by e-mail.
§ 6. Payments, discount codes, guarantee
- The fee is payable in advance, on the basis of a VAT invoice issued in the National e-Invoicing System (Krajowy System e-Faktur, KSeF), a copy of which the Provider sends by e-mail, within 7 days of the invoice being made available. For the month in which the Brand is created — in proportion to the number of remaining days. The Provider invoices limit top-ups and “Switch on today” separately.
- Discount codes. A code reduces the fee by a fixed net amount per month for the number of months specified for the code, counting from the month in which the account’s first Brand was created. A code may be entered only at registration; it has an expiry date and a usage limit, cannot be combined with another code and cannot be exchanged for cash. The discount does not reduce the fee below zero.
- Money-back guarantee in the first month. A Client who, within 14 days of creating the first Brand, cancels the Centre (with the “I’m cancelling — write to us” button or by e-mail) receives a refund of the fee for the Brand (the “Start” plan) in full, and of the fees for AI add-ons — reduced by the used part of the limit (as a percentage shown in the Centre). The refund is made within 14 days to the account from which the payment was received.
- Where payment is more than 14 days overdue, the Provider may — after giving notice by e-mail with a deadline of at least 7 days — suspend publications and AI functions; the Client’s data and content are retained until the agreement is terminated.
- Promotions are announced by the Provider; their terms are set out in the announcement and take precedence over the price list to the extent they govern.
§ 7. Technical requirements
- An up-to-date web browser with cookies and JavaScript enabled; an authenticator app (TOTP codes) on a phone; internet access.
- For publication from the Centre — a business account on Facebook and Instagram connected to the Centre. The Client may withdraw the permissions at any time in the Meta settings.
- For publication on X — an X account connected to the Centre (“Connect with X”). Publication on X consumes the Brand’s limit according to the price list. The Client may withdraw the permissions at any time in the X settings.
- The Centre uses only strictly necessary cookies (login session, choice of appearance, form protection) — without advertising or third-party analytics.
§ 8. Client’s obligations and prohibited content
- The Client warrants that it holds the rights to the materials it uploads to the Centre (photographs, videos, music, logos, texts) and, where people appear in the material, the consent of those persons to the dissemination of their image (Article 81 of the Polish Act on Copyright and Related Rights).
- It is prohibited to supply and publish unlawful content, in particular: content infringing personal rights (dobra osobiste) or copyright, misleading content, covert advertising, unlawful advertising of medicinal products and medical devices, spam, impersonation of other persons, disinformation (including health disinformation), adult content and violence — as well as content infringing the rules of the platforms and the acceptable use policies of AI providers.
- The Client itself labels advertising collaborations and sponsored content in accordance with the law and the rules of the platforms.
- The Client keeps the Users’ passwords and codes confidential and is responsible for the actions of the persons to whom it has given access.
- It is prohibited to use the Centre to build or develop a competing product, to copy its screens, descriptions and workflows for that purpose, to reverse engineer it, to retrieve the Centre’s content automatically, or to share accounts with persons outside the Client. A breach entitles the Provider to block access immediately and to terminate the agreement without notice, and to claim damages under the general rules.
§ 9. AI-generated content and its labelling
- Materials from the Generator carry a permanent “AI” label in the Centre. The Client does not remove labels required by the platforms and by law (Article 50 of Regulation (EU) 2024/1689 — the AI Act).
- Texts from the Assistant are published after human review and Approval — the Client assumes editorial responsibility for them.
- Only photographs without people are sent to the Generator; the Generator does not change the appearance of the product. For medical devices, only the mode based on a real photograph is available.
- The provider of the Generator may use the photographs and descriptions sent to it to train its models. The Client sends to the Generator only materials to which it holds rights permitting such use, and without personal data.
- Outputs of AI may not be protected by copyright — the Provider does not guarantee the exclusivity of the output.
§ 10. Reporting unlawful content
- Anyone may report content stored in the Centre that they consider unlawful by e-mail to kontakt@iwaszka.pl with the subject “Content report”, stating the reasons, the exact location of the content, the first name and surname or name and the e-mail address of the person reporting, and a statement that the report is made in good faith (Article 16 DSA).
- The Provider acknowledges receipt of the report, deals with it without undue delay and informs the person reporting of its decision. If it restricts access to the Client’s content, it gives the Client a statement of reasons and information on the possibility of appeal (by e-mail to the same address; handled within 14 days) — Article 17 DSA.
- The Provider does not review Clients’ content on its own initiative; automated checks in the Centre (Brand rules, warnings for medical devices, AI labelling) serve the Client and do not constitute profiling.
§ 11. Complaints, availability, liability
- A complaint may be submitted by e-mail to kontakt@iwaszka.pl. The Provider replies within 14 days. An upheld complaint about an interruption in service — a reduction of the fee in proportion to the duration of the interruption.
- The Provider makes every effort to ensure that the Centre operates without interruption; announced maintenance work is carried out, where possible, outside the hours of 8:00–20:00. Data backups are made daily and are encrypted.
- The Provider is not liable for: content approved by the Client; the operation and decisions of social media platforms and AI providers; loss of profits; damage resulting from the Client disclosing passwords to third parties. The Provider’s contractual liability is limited to the amount of the fees paid by the Client for the last 3 months — this does not apply to damage caused intentionally.
§ 12. Changes to the Terms, notice, end of the agreement
- The Provider may change these Terms for important reasons (a change in the law, prices, the scope of services, or the rules of platforms or AI providers). It sends the new text to the Client by e-mail at least 14 days before it takes effect (30 days — in the case of a price increase). A Client who does not agree may terminate the agreement with effect from the date the changes take effect.
- Either party may terminate the agreement with 1 month’s notice expiring at the end of a calendar month (by e-mail). The Provider may terminate the agreement without notice in the event of a material breach of § 8 after an ineffective request to cease, and in the event of a breach of § 8(5) — without such a request.
- After the end of the agreement, the Client may download its content and materials for 30 days; the Client’s data is then deleted, and backups — in the course of their rotation (up to 90 days), unless the law requires longer retention (e.g. invoices, the archive of advertisements for medical devices — 2 years, Article 61 of the Polish Act on Medical Devices).
§ 13. Sole traders with consumer rights
- A Client who is a natural person carrying on a business activity and for whom the agreement is not of a professional nature (Article 385⁵ of the Polish Civil Code) enjoys protection against unfair contract terms (klauzule niedozwolone) and may withdraw from the agreement within 14 days of its conclusion without giving reasons (Article 38a in conjunction with Article 27 of the Polish Consumer Rights Act). If that Client requested the service to begin before the end of that period, it pays for the period of use until the moment of withdrawal.
- The limitation of liability in § 11(3) does not apply to such a Client to the extent that it would be unfair.
§ 14. Personal data and final provisions
- Personal data that the Client enters into the Centre or that the Centre processes for the Client’s Brand (the Client’s Users, the content of comments under the Brand’s posts, images in materials, consents) is processed by the Provider on behalf of the Client — under the data processing agreement in Annex 1, which forms part of the agreement. The contact and billing details of the Client and of the person creating the account are processed by the Provider as controller — in accordance with the privacy policy.
- The governing law is Polish law. Disputes are resolved by the court having jurisdiction over the Provider’s registered place of business — except for disputes with a Client referred to in § 13.
- These Terms are available free of charge at https://social.iwaszka.pl/regulamin in a form that allows them to be saved and printed. They apply from 28 October 2026; for Clients who concluded the agreement earlier, they apply from the date indicated in the notice of change (§ 12(1)).
Annex 1 — data processing agreement (Art. 28 GDPR)
- Parties and subject matter. The Client (controller) entrusts the Provider (processor) with the processing of personal data to the extent and for the purpose necessary to provide the Centre service — for the duration of the agreement and the period referred to in § 12(3).
- Type of data and categories of data subjects. The Client’s Users (login, first name and surname, e-mail, activity log); persons commenting on the Brand’s posts (the content of the comment and its time — without the author’s name or identifier; comments concerning health — masked); persons appearing in materials and their consents; other data that the Client itself places in notes, materials and content.
- Nature of the processing. Storage, organisation, display, preparation of drafts by the Assistant, publication on the Client’s instructions, backups, deletion.
- Provider’s obligations. The Provider: (a) processes the data only on documented instructions from the Client — instructions include, in particular, Users’ actions in the Centre and these Terms; (b) ensures that persons authorised to process the data have committed themselves to confidentiality; (c) applies the security measures referred to in Art. 32 GDPR, including: login with a password and a one-time code, encryption of connections, encryption of access keys and backups, an activity log, and restriction of access to Brands; (d) assists the Client in fulfilling the rights of data subjects and the obligations under Arts. 32–36 GDPR; (e) notifies the Client of a personal data breach without undue delay, and no later than 48 hours after becoming aware of it; (f) after the end of the service, deletes or returns the data in accordance with § 12(3); (g) makes available to the Client the information necessary to demonstrate compliance with its obligations and allows an audit on at least 14 days’ prior notice, at an agreed date.
- Sub-processors. The Client gives general authorisation for the use of sub-processors of these types: a server provider (data centre in the European Union), a provider of the Assistant’s language models, a provider of the Image and Video Generator (only with the “AI graphics and videos” add-on and only materials without personal data) and a provider of outgoing mail and storage of encrypted backups. The current list with the names of the sub-processors is available to the Client in the registration confirmation e-mail, on the account confirmation page (before the agreement is concluded) and in the Centre (Help → Documents). The Provider informs the Client by e-mail 14 days in advance of any intended addition or replacement of a sub-processor; the Client may object and terminate the agreement. The Provider imposes the same data protection obligations on sub-processors.
- Transfers outside the EEA. Where a sub-processor processes data outside the European Economic Area, this takes place on the basis of a Commission adequacy decision or standard contractual clauses adopted by the Commission.
- Social media platforms. Meta (Facebook, Instagram), X and other platforms on which the Client publishes are not sub-processors of the Provider — the Client uses them under its own agreements with the platforms.
